EmailBuilder License
The EmailBuilder editor and its contents including, but no limited to, name, text, pictures, photographs, software, applications, icons, graphics and animation… (hereinafter referred to as « EmailBuilder ») are the sole and exclusive property of Sarbacane Software, 3 avenue Antoine Pinay, Parc d’activité des 4 vents, 59510 HEM – RCS Lille Métropole 509 568 598 and its partners.
The EmailBuilder is distributed under the property license.
Sarbacane Software grants you a non-exclusive and non-transferrable right to use the EmailBuilder throughout the illimited duration, to compose and read messages with the Sarbacane Software Service (sending Email marketing campaigns). You undertake to observe the proprietary notices indicated on the EmailBuilder. You are prohibited for disseminating, assigning, renting, leasing, sub-licensing, giving or distributing any and all of the Emaibuilder to a third party in any way whatsoever.
This License does not include the right to collect or use information contained on EmailBuilder for purposes prohibited by Sarbacane Software and/or to compete with Sarbacane Software. Likewise, translating, adapting, assembling, dismantling, compiling, reverse engineering, arranging or modifying the EmailBuilder and exporting or merging it with other technologies outside the situations allowed by the French law is prohibited.
Any use of the EmailBuilder contrary to the that would not fit the intended purpose (for which they have been designed) is strictly prohibited.
As a result, any resale or commercial use of the EmailBuilder or any other means to seek financial gains through providing EmailBuilder to a third party without prior written consent from Sarbacane Software is strictly prohibited.
Sarbacane Software makes corrections to their EmailBuilder themselves. Therefore, intervening or having a third party intervene with the EmailBuilder is prohibited. This License does not grant you any right to demand evolutional updates or new versions of the EmailBuilder.
The EmailBuilder may be evolved, modified or deleted without prior notice.
To protect the rights of copyright holders, we reserve the right to terminate the accounts of infringers immediately and without notice.
No warranties.
TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, SARBACANE SOFTWARE, AND ITS AFFILIATES, PARTNERS, AND SUPPLIERS DISCLAIM ALL WARRANTIES, STATUTORY, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM SARBACANE SOFTWARE WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN.
“As is” and “As available” and “With All Faults”.
TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, YOU EXPRESSLY AGREE THAT THE USE OF THE EMAILBUILDER IS AT YOUR SOLE RISK. THE EMAILBUILDER, USER SUBMISSIONS AND ANY THIRD-PARTY MEDIA, CONTENT, SOFTWARE, SERVICES OR APPLICATIONS MADE AVAILABLE IN CONJUNCTION WITH OR THROUGH THE EMAILBUILDER IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE”, “WITH ALL FAULTS” BASIS AND WITHOUT WARRANTIES OR REPRESENTATIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED.
This license is subject to the French law.
This license can be modified by Sarbacane Software at its sole discretion. Your continued use of the Emailbuilder after 30 days following the posting of such changes or modifications will constitute your acceptance of such changes or modifications.
